An image of the Betelgeuse, on the morning of its sinking, 8 January 1979. It is taken from a promotional leaflet issued by the Dutch salvage company K.G. Tenderhof & Co, who claim to be successors to the Betelgeuse salvor L.Smit & Co. Fair use claimed for the Betelgeuse incident and Whiddy Island disaster articles on the following rationale :

(1) The use of the image is to stimulate creativity for the enrichment of the general public. It is for a nonprofit, educational purpose. The subject of both articles is the sinking of the Betelgeuse and the subject of the image is of the Betelgeuse sinking. Clearly, the image is impossible to recreate

(2) The image is of a factual and nonfictional nature and it has previously been widely published and circulated

(3) The image is being used for critical purposes

(4) This present use of the image has no impact on the image's marketability or sales value. It is probably adapted from an obsolete newspaper photograph. In the form used here it is extremely low resolution.
