Rationale

This brick wall is the only surviving, standing piece of the Duquesne Gardens that was demolished in August 1956. The brick wall is currently serving a memorial to past Pittsburgh teams, that have played at the Gardens, inside the Consol Energy Center. I Pennsylvania Penguin took a photograph of this memorial on December 28, 2012.

Though several of these photographic images are subject to copyright, their use is covered by the U.S. fair use laws because:

  • They illustrate an educational article about the Gardens and teams from which the illustrations were taken.
  • The images are used as the primary means of visual identification of the article topic.
  • Their use of the illustration will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies could not be used to make illegal copies of the images. # They are a low resolution image.
  • The image is only a small portion of the commercial product.
  • They are not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
