DescriptionBush-9.jpg | Photocopy of Bush v. Martin, 224 F.Supp. 499 (D.C. Texas 1963), a civil lawsuit filed by plaintiffs George H. W. Bush (chairman of the Harris County Republican Party) and others vs. defendants Crawford Martin, Secretary of State of the State of Texas; John Connally, Governor of the State of Texas; Waggoner Carr, Attorney General of the State of Texas; the acting Chairman of the Executive Committees of the Texas Democratic and Republican Parties, respectively; and various local Texas officials. The plaintiffs sued upon the constitutionality of Texas statutes apportioning congressional districts among the counties and citizens of the State. The suit was filed in Federal District Court on April 23, 1963, and was tried in September 1963. A three-judge panel decided for the plaintiffs, and published their decision on October 19, 1963. The three-judge panel found that the population disparity among Texas Congressional Districts — ranging from 216,371 to 951,527 — was "indeed spectacular" and noted that marked under-representation was "not surprisingly" found in metropolitan districts. By decree, the District Court declared that the current apportionment of Congressional Districts under Article 197a of the Texas statutes was unconstitutional and void, and the defendants were enjoined and restrained from enforcing the statute. And until the Texas legislature passed substitute legislation, Members of Congress for the State of Texas would be nominated and elected from the state at large. The judgment was affirmed on appeal to the U.S. Supreme Court (by a 7-2 vote, with Chief Justice Earl Warren in the majority) on March 2, 1964. |
