re NHS Japan row template

My understanding of template coding is pretty much nonexistent, but don't you need {{if#}} or something for the "lat" and "lon" fields so that the template doesn't display an error message if those fields are left blank (as it's currently doing at Template:NHS Japan row)? File:Musée Hergé.jpg

Hello Multichill! Would you please remove File:Musée Hergé.jpg from your User:Multichill/Free uploads/2013-07-13 area? I ask because the licensing for that particular file is quite narrow and probably does not allow you to link to it as you have done. I went through some hell just keeping this file of User:Peripatetic available to be seen by the public on two Wikipedia pages—the file was deleted until I won the battle to save it—and we do not want to risk any more issues. Does a file that is was given to the community via Creative Commons Attribution-ShareAlike 3.0 need a "non-free" rationale? —Prhartcom (talk) 16:04, 29 September 2013 (UTC)

The image is not free, see commons:Commons:Deletion requests/File:Musee Herge.JPG so you end up having to use fair use for this.

Oh, and btw the {{FoP-USonly}} doesn't cover artworks like the big TinTin in the image. Multichill (talk) 16:38, 29 September 2013 (UTC)

The link you point to refers to commons:Commons:Freedom of panorama#Belgium and is not applicable on en.wikipedia. That is the reason for the deletion in Commons and the reason why I worked with the uploader to move the file here. The image of Tintin is a part of the architecture and is considered De minimis use of a copyrighted work. Meanwhile, the photographer has always released it as a free image via Creative Commons Attribution-ShareAlike 3.0. Does this clear up the confusion or is there anything I am not understanding? —Prhartcom (talk) 16:59, 29 September 2013 (UTC)

I don't think TinTin is de minimis, it's the central part of the image, not an accidental inclusion. Multichill (talk) 18:38, 29 September 2013 (UTC)

1. It's not "TinTin", it's Tintin, as indicated in Wikipedia and as I have indicated above. Please make an effort to spell the name correctly.
2. You haven't responded to my informing you that the link you point to refers to Commons:Freedom of panorama for Belgium and therefore the link you cite is not applicable on the English Wikipedia, nor have you responded to my informing you that the original photographer has always released this file as a free image via Creative Commons Attribution-ShareAlike 3.0 (there is no copyright). Please respond specifically to these, recognizing that I, and other editors of both Wikipedia and Commons who brought this file to this state, who have given this file their tacit approval, believe that these two allow the use of this file in the way in which it is being used.
3. You appear to be claiming that, despite the Freedom of Panorama laws of images of architecture and the ShareAlike 3.0, this permanent architectural feature of the architect's design of the Hergé Museum building—namely its image of Tintin—means this file should be treated the same as a Tintin poster or Tintin book cover. Keeping in mind the other editors that worked with me to get this file to this state, is that truly what you are asserting?
4. You never answered my original polite and personable request to please remove the image from your user area. (You seem to have a large collection for some reason). Instead, my request apparently gave you the idea to behave officiously to me, informing me you'd like the file to be deleted, ignoring my request. Today you are putting me through the hell I went through the first time to keep this file from being deleted. Obviously I am VERY sorry I ever contacted you in the first place ... but since I have, would you please consider honoring my original suggestion to remove the image from your user area?

I'm sure your intentions are good and you are only trying to do the right thing. I am considering giving this free file a non-free rationale, as you request. One of the things stopping me is that doing so will put the large red copyright symbol on the file description page, right underneath the "no copyright" symbol, which will require that the image be made smaller. These are two things stopping me from giving it rationale. What are your thoughts on this, would you please consider just removing your tag from the file?
